Photography Services Terms & Conditions

Booking and Payment

Clients will be sent the full photography Agreement for review and signing via Hellosign in advance of the session. 

 

The session price includes a non-refundable payment of $100 must be paid within 72 hours of booking.  The client’s booking date and time will be reserved upon payment of the deposit and signing of the Agreement.  The session fee must be paid in full on or before the date of the session. No products will be delivered before the session fee is paid in full.  

 

Payment plans can be arranged upon request. 

 

Cancellation

If the Client fails to show or cancels 2 or less calendar days before the agreed upon photographic event date, the initial non-refundable payment will be forfeited.  The non-refundable payment may be applied to a mutually agreed upon date if the request to cancel or reschedule is made 3 or more calendar days before the session.  The remainder of the session fee will be refunded.

 

Rescheduling/Late Arrivals

If Client requests to reschedule a photographic session, the Photographer may apply the initial payment to a rescheduled session if notice is given at least 3 days prior to the scheduled session.  The rescheduled session must take place within 6 calendar months. Any Client that arrives late to the session will have the amount of time late deducted from the time allotted for the session. Photographer will not provide a partial refund or other compensation for the time deducted from the session due to late arrival of the Client.  

 

In the event that the weather conditions are not desirable for the shoot based on Photographer recommendations, the session will need to be rescheduled and the fee will be waived or an alternative location agreed upon. Due to liability and equipment damages, this decision will be at Photographer’s discretion. 

 

Location & Travel

If Client specifies a certain location to be used during the shoot, the client is responsible for all location fees involved such as location access fees, parking, and other expenditures directly required for fulfillment of the Agreement. 

 

For locations 10 miles outside the zip code 98199, $0.58 per mile will be added to the session fee.

 

Copyright and Client Print Release

All photographic materials, including but not limited to negatives, transparencies, proofs, and previews, will be the exclusive property of the Photographer.  Photographic materials may be used for the promotion of this business.  Private galleries are available for an additional $100 fee. A print release will be provided to the client along with the Agreement and specifies usage of the photographic materials.   

 

Products Delivery

The client will receive high-resolution digital files available for viewing and downloading in an online gallery.   The online gallery will be available within 3 weeks of the photographic event and will be open for 90 days. The quantity of images depends on the session length selected and will be specified in an online quote.  

 

Styling

Recommendations may be provided by the Photographer.  Final styling choices will be made by the client. Reshoots are not available due to styling choices.

Failure to Perform

If the Photographer is unable to perform this Agreement due to illness, emergency, fire, casualty, strike, act of God, or causes beyond the control of the Photographer, the Photographer and the Client will make every attempt to reschedule the photographic event. If a reschedule is unable to be agreed upon, the Photographer will return the initial nonrefundable payment to the Client and will have no further liability. Further, if the Photographer is unable to deliver photographic materials due to technological malfunctions, including but not limited to the equipment operation and image processing, or photographic materials are otherwise lost or damaged without fault of the Photographer, liability will be limited to cost of the Agreement. In no event will Photographer be liable for any amount exceeding the cost of the Agreement.

 

Substitute Photographer

The Photographer reserves the right to provide a substitute with another photographer in the event Photographer is unable to perform. 

 

This Agreement shall be governed by the laws of the State of Washington.
